Can My Domain Name Contain Another Companys Trademarked Name?

Can my domain name contain another companys trademarked name? For example, if I were to purchase a domain name like, www.buyusednikesneakers.com and sold used nike sneakers on there would it be legal? It’s the same idea as ebay just with a more specified niche and specified domain name.

    I’m pretty sure you wouldn’t be able to use it. If the domain were available and you’ve already purchased it then you’re out the $20 or whatever it cost you.
    Nike will find out about it and they could come back to ask for a portion or all of the money from the sales that you generated. Being out the money for the cost of the domain is nothing compared to what a world renowned corporation could do to recover costs.

    It is illegal to use a trademark of a company or a person’s trademark in your domain name. Just be creative in creating your unique domain name. If you use another person’s trademark, you’ll be sued and maybe pay a fine for using the goodwill of that trademark in doing business.

    Do not make problems later on that will interfere with your business is caused by a domain name.
    If this happens yet the webmaster claims the domain name anyway, they are at risk of losing it through a domain name arbitration proceeding. They could even be charged with trademark/copyright infringement if things get really ugly. For this reason it’s best to make sure the keywords used in a domain name aren’t protected for someone else.

    You would probably be ok since you are selling a used product. There are circumstances where you can use a trademark in a domain. Gripe sites are allowed to use them. Like nikesucks.com or whatever. I would probably register usedsneakers.net and then create a sub domain/page for each brand you want to sell. http://www.nike.usedsneakers.net, http://www.reebok.usedsneakers.net. This would work well with search engines and you are not limiting yourself to one brand. If business takes off you don’t have to worry about your domain.
