I cashed a (SCAM) check from Global Test Market, consisting of 3,990 in exchange for “secret shopper” benefits. It was a cashier check. I cashed it at Sovereign bank. When I called, the bank told me no one was available in the fraud department to help me. I really don’t want to get into trouble for not knowing what I was doing. Is there any way to fix this? Please help. I don’t know what else to do and don’t want to be fined, or even sued.
You will have to pay the bank $3990 plus any bounced check fees (usually $35-45) whether you withdrew it or not.
The first thing you need to do is go to your local police station with print outs of any emails you received, with FULL headers, and tell them what happened. Then bring a copy of the police report into your bank and speak with the manager. This MAY prevent the bank from charging you the $3990 but there is no guarantee
The non-profit Fraud Aid has a lot of information regarding check fraudhttp://www.fraudaid.com/check_liability.…
“Check cashing and account holder responsibilities are the same in all countries:
You cannot rely on your bank, credit union, PostBank, or check cashing store to protect you from counterfeit, stolen, or forged drafts. It’s not their job to watch out for you, it is your job to watch out for them. Like you, merchants, banks, and credit unions have the rightful expectation of being given good money.
BY LAW YOU ARE LEGALLY RESPONSIBLE AND FULLY LIABLE for any and all checks or money orders deposited into your bank account by you or someone else, and for any funds wired into ANY of your accounts by you or someone else.
Your are 100% liable for any and all funds deposited into any of your accounts by any means whatsoever.”
You won’t be sued but you will have to pay back the money. It happens to a lot of people, including a friend of mine but he didn’t lose as much as you will because you will have to give them 3,990. And they have the right to attach your wages.
