I know they say you have to sign a consent before they could obtain your old records but I’ve heard differently, if he is an affiliate of a hospital does he then have permission to my old records?

If both your old and new Psychiatrist are members of the same practice, and you signed a disclosure that they share information from within the practice, then they’ll have access to your old records. However, if they are only affiliated because they can treat patients from the same hospital, then there is no agreement to share information. You’ll need to sign a consent form to transfer your records. Even then, limitations will exist on how much they’ll transfer to the new psychiatrist.
You can also get these records released to you. However, if the Psychiatrist thinks that the informatino may cause you to react in a way that could cause you or someone else harm, then they can require that the information be provided to you through a therpay session with either your old or new Psychiatrist.
You have to give your permission or he can not get them.
