The Brattle Center (TBC) is a struggling mental health clinic based in Harvard Square. Its founder, Dr. Joan Wheelis, is a nationally recognized practicing psychiatrist who has developed outpatient treatment programs based on Dialectical Behavior Therapy (DBT) for patients with borderline personality disorder (BPD).
DBT requires teams of people with different types of expertise and so the original operating model developed by Dr. Wheelis was one in which TBC was staffed by a large number of part-time clinicians, known as the “affiliate model.” Changes in the health care environment, particularly the advent of managed care, have put very real pressures on this model and the company is now in a state of crisis.
Dr. Wheelis is trying to decide whether and how to keep it going. The key decision is whether to shift to a “staffing model” based on a larger number of full-time clinicians. This will require a larger patient population to make the economics of greater fixed capacity viable.
TBC is trying to decide whether to join the Blue Cross Blue Shield network, which would increase its patient population but at rates much lower than it currently charges by only taking private patients. Dr. Wheelis is also pondering whether to start a non-profit foundation as a way of getting money to support its teaching and training programs, or even making the company a non-profit itself.

SITUATION
The Golden Bay Star Hotel was developed by a group of investors in the
late 1970s to be the premier luxury property of its type in the Bay Area.
The location in downtown was chosen for its proximity to the financial
district and art gallery community.
In its early years of operation, the Golden Bay Star enjoyed modest
success. But the ownership felt that better performance was possible.
They decided that name recognition was what they lacked. By 1982 the
ownership decided to affiliate the hotel with a national luxury management
company. The hotel and management company signed an agreement
that was renewable every five years.
For the next few years, the Star (as it is called) experienced record
revenue performance. The boom in the financial markets was reflected in
strong transient and group demand at high rates. The art market was
experiencing strong interest from individual and institutional inventors
from across the world. Auctions and other meetings were traditionally
held at the Star. All parties involved were satisfied with the arrangement.
By the late 1980s, accelerated hotel construction in the vicinity of the
hotel began to manifest itself. Properties of all product types and sizes began
to pop up all around the Star. Newly developed hotel concepts (the extended
stay and all suite) started to vie for the traditional business of the Star.
After several years of declining performance, the hotel owners began
to get nervous. They needed to know why they were in this situation and
how it would be remedied. The ownership sent a representative, Tom
Anderson, to the hotel to monitor the situation. Tom met with the hotel’s
general manager, Shelly Burns. Shelly had been at the hotel for 10 years.
She had been on board for the period of exceptional performance, so
naturally as the leader, she had been lauded. She was not used to being
in the position of having to explain poor performance.
Shelly Burns was a “hands on” general manager. She involved herself
in all aspects of operations and sales. She was so involved in sales
and marketing, she saw no need for a change. They had never needed to
advertise, and the sales office seemed to run itself. After all, she could
make those decisions if need be, so why incur the extra salary costs?
The senior sales person at the Star, Frank Nevins, had been on staff
since the opening of the property. He had long enjoyed a healthy relationship
with the local financial community. His contacts were renowned,
and he spent a great deal of time cultivating those relationships.
Tom asked Shelly to take a good look at the current state of the hotel.
He needed to report back to the owners and wanted a solid plan from the
hotel as to how it would improve performance. The owners were in the
fifth year of their current management contract and needed to act quickly.
He gave her one week to come up with a plan.
DISCUSSION
If you were Shelly, what would you do? This case presented background
on a fictional hotel, but these situations occur every day. As a group, or as
assigned, develop a plan for the Star. What factors should you take into
consideration?

This was on an open, public facebook account with my name tagged into the photo. I didn’t know I was tagged until just yesterday, where I promptly untagged myself and reported the comments. Before untagging myself, I took a video of all the comments made. The photo had me and a “supposed friend” at a party. These statements were made on December 28th, 2010. I was tagged with these statements for 2.5 years. My picture is still affiliated with these statements. This has been reported to facebook.
Individuals 1 and 2 I knew from high school. Individual 1 harassed me in high school and then later in college. We never interacted–we never hung out or talked to each other. He hated me from the start and it was until much later that I learned it was because I was dating a girl he liked. This continued for several years. I was afraid of him in high school and is the reason why I learned martial arts. Individual 2 I knew in high school. We rarely interacted individually unless a group of friends were present. Otherwise, lengthy conversations never took place.
Individual 3 I only knew threw my ex’s (girlfriend at the time) brother as he was dating individual 3. I considered her as a friend, but later learned that she never liked me from the beginning. Through slander and libel, she caused me a lot of grief. I lost friends, had major depression and anxiety, and had people approach me for things I hadn’t done, for which both my ex and her brother denied and defended me for. I am still friends with my ex and her brother.
Individuals 1, 2, and 3 were all friends at the time. Individual 1 is no longer friends with individual 2 or 3. Individuals 2 and 3 are still friends. They have been known to turn fact into fiction with grandiose exaggeration.
Two of the individuals I knew from high school. The first individual and I talked every now and then, but never hung out. The second individual simply hated me from the beginning because I was dating a girl he liked. This I didn’t know. I was afraid of this individual in high school. High school graduation was 2007. The third individual I had only met recently through a friend, but had minimal interaction with, which changed over time as she became slanderous to my name. Other people randomly came up to me angry for things that had never transpired. Due to the slander, I lost several “friends.”
These are direct quotes.
Individual 1: “I hate that guy so much :P”
Individual 2: “I know! He is such a jerk, I mean look at this photo, he clearly doesn’t understand me so his blood vessels exploded everywhere.”
Individual 1: “What an ***.”
Individual 2: “Exactly. I hate him. :'(”
Individual 1: “Let’s sell him off to aggregate farmers in Nepal.”
Individual 2 (This quote in particular was shocking and upsetting):
“I was going to kill him but that plan makes money and less blood is involved. I second
that motion.”
Individual 1: Passed.
Individual 2: “I just noticed that (my name) and I have photos of him and I. Yep, totally hate him.”
Individual 1: “What a fagmuffin.”
Individual 2: “Oh totally. Wait, no, he is pumpkin spice.”
I don’t entirely understand that statement.
Individual 3: “That’s totally what happens when (my name) pisses me off. See? He’s even hanging his
head in shame of what he obviously did wrong.”
Individual 2: “Sooo true. This is why we hate him.”
I am highly educated in science, but not with the law.
Would this be a case for libel, something else, or perhaps nothing at all?
